Postby jmama55 » Sun Aug 24, 2008 1:43 pm

i too am trying to figure out how to ask the same thing. i paid over 4000 for full face co2 laser one yr ago and have had one yr of hell. i am now going to a dermatologist and an ophtholmologist plastic surgeon and am going to have eyelid surgery to repair damage caused by my ps. i want to ask the ps if her insurance will pay for the all the medical expenses her screw-up has caused me. i figure it is better than legal action. any suggestions out there?

I am also looking for my money back instead of legal action. I had a dermabration on my cheecks and had agreed with the doctor to do fat transfers in order to assist the dermabration on my acne scars. When I woke up from the surgery he placed cheeck implants and told me I will thank him when I'm old. I had never considered placing something foreing inside my body and now I know why I was right. It feels ackward when I lay my face on a pillow, or lay on my stomach to sleep, I often have to move my face around until I find a comfortable spot, when my fiancee kisses me or is playful with my face I often feel the implant. It's weird and I don't like it. I now know that I will never go through surgery again, no matter how my body naturally changes, is not worth it. If I take my implants out, I'm afraid of the scar tissue and my face sinking in. All I wanted was for my skin to look smoother due to my acne scars. If anyone has any advice, please help.

Request from the doctor a copy of the LEGAL DOCUMENT you signed; "informed consent".
Request from your doctor a copy of the SURGICAL RECORD on which it should state he placed cheek implants.

Look on the legal document to see if you actually consented to cheek implants. If the document DOES NOT show that you actually consented to them prior to your surgery, then you had them via "uninformed consent".

After you have requested those documents, politely request a refund. (If the matter is one of uninformed consent, he will have a 'clue' what information you have in your possession and should want to rectify it personally with you.)

With that he might want to have you sign a document waiving your option to pursue litigation. Which is fine if you don't want to litigate.

However, if he refuses to give you a refund, get in touch with a lawyer and have him evaluate "uninformed consent". The lawyer should be able to help you get your money back.

I had cheek implants removed. The first time was becuase he put a size 2 when I requested a size 1 because he thought size 1 was too small. I looked like a chipmunk with size 2, though. Then after size 1 was put in, I could notice the outline of my cheek implants in nightlight so I had them removed. I suppose if you have more fat on your face you will not be able to see the outline. The surgery only cost me $600 at the time so I did not ask for a refund. I should have when he put size 2 instead of size 1.

I had another surgery which the doctor did not follow directions. On the operating report it said he was supposed to do something, but he did not do it. So, I have to have the surgery performed again. I requested a refund and he gave it to me. However, this doctor was ethical although he did not know how to repair my problem. I think if the doctor is ethical, he will give you a refund.

I think I look better without the cheek implants. Maybe just a little scar tissue built up which does not make my cheeks look as flat. What I did not like about the cheek implants is that they made my profile look bold when I have soft features.
